Multiple cities across China are intensifying enforcement against drivers illegally operating as ride-sharing services under the guise of carpooling.1 Some drivers have adopted high-frequency order acceptance and fixed-route patterns to operate as unlicensed commercial services.1 Ride-sharing, as a non-profit shared mobility approach, differs fundamentally from for-profit ride-hailing services, yet distinguishing between the two in practice remains challenging.1
Authorities have begun implementing quantitative management measures to address the issue. Starting July 2026, Henan Province's transportation authority will place vehicles that publish 20 or more fixed-route ride-sharing orders or cancel orders 60 times or more after acceptance onto a priority rectification list.1 Guangzhou's transportation bureau has proposed stricter limits, capping ride-sharing pickups at three daily rides or two cross-city rides, with new energy vehicles subject to a 30 percent price restriction.1
Experts emphasize that the core distinction should center on driver intent. Gu Dasong, executive director of the Southeast University Center for Transportation Law and Development, notes that ride-sharing is legally classified as civil mutual aid, whereas ride-hailing constitutes commercial passenger transportation services with fundamentally different characteristics.1 The State Council's 2016 guidance on taxi industry reform explicitly defines the essence of ride-sharing as non-profit sharing, indicating that a comprehensive approach combining regulation with accommodation is necessary to resolve the compliance ambiguity.1
