China's housing ministry and financial regulators have unveiled a comprehensive overhaul of residential property sales practices aimed at strengthening buyer protections and stabilizing the real estate market. In August, the Ministry of Housing and Urban-Rural Development, the Ministry of Natural Resources, and the Financial Regulatory Administration jointly issued a notice outlining reforms to the commercial residential housing sales system.1
The new regulation stipulates that pre-sale properties must have their main structural framework completed before they can be marketed to buyers.1 All purchaser funds—including down payments and mortgage proceeds—must be deposited into supervised accounts, with access to these funds restricted until project completion and acceptance by authorities.1 For pre-sale mortgages specifically, loan disbursement will occur only after the project achieves completion registration.1 To ease financing pressure on homebuyers, the maximum individual residential mortgage term has been extended from 30 years to 40 years.1
The reforms introduce an exclusive banking arrangement for each development project, with one designated lead bank assigned per project.1 New residential properties on newly auctioned land are now prioritized for sale as completed units rather than pre-sale properties.1 These measures are designed to reduce delivery risks, safeguard purchaser rights, and promote high-quality development of China's real estate sector.
