A Nevada judge has dismissed charges against six Republican electors who were accused of submitting a fraudulent certificate claiming Donald Trump won the state in the 2020 presidential election.[1] Judge Mary Kay Holthus ruled that prosecutors failed to present evidence demonstrating the defendants intended to deceive government officials, and that the prosecution did not disclose evidence favorable to the defendants to the jury.[1] The judge stated that "the defendants publicly announced their actions and alleged purpose rather than concealing their actions or attempting to secretly induce government reliance, which weighs against a reasonable inference that they possessed fraudulent intent."[1]
The six defendants include Michael McDonald, Nevada's Republican Party chairman, and Jesse Law, former chairman of the Clark County Republican Party.[1] President Biden won Nevada by more than 30,000 votes.[1] Nevada Attorney General Aaron Ford announced plans to appeal the dismissal.[1] This ruling represents the latest setback in prosecutions of so-called fake electors across swing states, following similar case dismissals in Michigan and Georgia, and the withdrawal of federal charges by the end of 2024.[1]
