海洋环境公益诉讼强制执行案判决赔偿185万余元,采用"异地修复"方式执行[1]。生态损害赔偿协议司法确认案的赔偿总额为190278元,进行了全国最大单笔盐沼司法蓝碳交易[1]。非法采捕红珊瑚案中,19名被告人分别判处有期徒刑十二年六个月至九个月,涉案红珊瑚总价值2592.72万元[1]。
The Ecological Environment Code of the People's Republic of China will take effect on August 15, 2026.[1] To mark this milestone, the Supreme People's Court has released six representative cases demonstrating judicial protection of marine ecological environments, covering critical areas including vessel pollution, land-based pollution, marine protected area management, and the conservation of rare aquatic species.[1]
The first case involved an oil leak from the "Tian Mou 1" vessel during port operations, resulting in compensation of over 10 million yuan and marking the first judicial confirmation that atmospheric environment damage and marine environmental capacity loss qualify as compensable harms.[1] A separate dispute concerning the Huodong sea turtle national nature reserve resulted in a court ruling that agreements failing to comply with environmental assessment and protected area approval procedures are void.[1] In a land-based pollution case, a defendant was ordered to pay over 3.87 million yuan in ecological damage compensation plus interest.[1] A marine environmental public interest litigation enforcement action resulted in a judgment of 1.85 million yuan in compensation, executed through an "alternative restoration" approach.[1]
An ecological damage compensation agreement case confirmed a settlement totaling 190,278 yuan and involved the nation's largest single judicial blue carbon trading transaction for salt marshes.[1] In a case of illegal harvesting of red coral, nineteen defendants received sentences ranging from twelve and one-half years to nine months in prison, with the seized red coral valued at approximately 25.93 million yuan.[1]
