The U.S. Federal Communications Commission has moved to prohibit the importation and sale of foreign-made drones equipped with LiDAR sensors, classifying the technology as "military-grade."[1] The proposal, published in the Federal Register on August 3, 2026 under designation DA 26-758, builds on an earlier FCC order issued on December 22, 2025, that added all foreign drones to the agency's covered list.[1] Popular consumer models including the DJI Air 3S and Mini 5 Pro would be affected by the retroactive ban.[1]
The FCC's "military-grade" classification encompasses a broad range of unmanned aircraft beyond those with LiDAR capabilities, including drones equipped with thermal imaging sensors, those capable of agricultural spraying, models weighing 55 pounds or more, drones with docking stations, systems with integrated defense articles, and coordinated operation features such as drone light shows.[1] The public comment period for the proposal extends until September 2, 2026, and if adopted, the ban would take effect approximately 180 days after publication.[1]
DJI has contested the classification, arguing that LiDAR serves as a safety feature rather than a weapon and disputing the "military-grade" designation as a mischaracterization.[1] The company has previously challenged the FCC's initial restrictions through legal action.[1]
