A federal judge in Michigan has cleared the way for a civil rights lawsuit to proceed to trial following the fatal shooting of a 26-year-old man by a police officer.[1] U.S. District Judge Paul Maloney ruled on Thursday that video evidence demonstrates Officer Christopher Schurr shot an individual who posed no violent threat, was unarmed, and was physically restrained by the officer, thereby violating Fourth Amendment protections.[1]
The incident occurred in 2022 when Schurr, a Grand Rapids police officer, fatally shot Patrick Lyoya, a 26-year-old Congolese immigrant, during a traffic stop.[1] Schurr claimed self-defense, asserting that Lyoya had gained control of his Taser gun.[1] However, the judge found that Schurr's account of the Taser incident was inconsistent with the video record.[1] A second-degree murder charge against Schurr was dismissed after a jury failed to reach a unanimous verdict.[1] Schurr, who had served as a Grand Rapids officer for seven years before being terminated following the incident, now faces civil damages claims brought by Lyoya's family.[1]
