The Senate Homeland Security and Governmental Affairs Committee is scheduled to vote on Thursday on whether to hold Anthony Fauci, the former director of the National Institute of Allergy and Infectious Diseases, in contempt of Congress and refer the matter to the Department of Justice.[1] Fauci invoked the Fifth Amendment more than 100 times during a hearing the previous week, declining to answer questions.[1]
Committee Chairman Rand Paul has argued that Fauci's pardon, which President Biden issued in January 2025 and which covers conduct from 2014 through the date of the pardon, eliminates the former official's concerns about prosecution.[1] However, the pardon does not shield Fauci from state-level charges or investigations into false testimony.[1] In a statement, Fauci expressed concern that Paul is "determined to put me in prison," responding to the chairman's push for the contempt vote.[1] Paul indicated he does not intend to pursue a full Senate vote on the matter, which would require 60 votes to pass.[1] The committee plans to vote Thursday morning on whether to refer the case to the U.S. Attorney's Office in Washington.[1]
