New South Wales Attorney-General Michael Daley has rejected findings from a parliamentary inquiry into allegations against Director of Public Prosecutions Sally Dowling, declaring the matter closed after receiving legal advice from three senior counsel.[1] The opinion, commissioned from former Law Society president Noel Hutley SC and his colleagues, concluded there is "no foundation for concluding [the DPP] had any idea of such a placement, whether at all or specifically to 2GB, or that the director authorised these things."[1]
The parliamentary inquiry's majority (voting 4–3) had determined that Dowling authorised her office to plant negative coverage about District Court Judge Penelope Wass with radio station 2GB and subsequently gave misleading evidence to parliament.[1] Dowling acknowledged in parliamentary testimony that her office provided a story about Wass to 2GB in October 2024, but denied authorising the disclosure.[1] She stated she had been "reading emails and text messages in the ordinary course relating to prosecutions and other ODPP matters" during the critical period.[1] The 2GB coverage concerned an incident in which Wass invited an Aboriginal youth to conduct a "Country welcome ceremony" during sentencing.[1]
Daley has rejected the inquiry majority's recommendations, including establishing a formal investigation and creating a new parliamentary oversight committee for the office of the DPP.[1]
