风电行业主控软件侵权问题由来已久[1]。早在2011年,美国超导公司曾控告华锐风电专利侵权,华锐风电最终赔偿5759万美元[1]。到2020年5月,华锐风电在一个月内连续起诉两家公司侵害其软件著作权[1]。从美国超导的诉讼到华锐风电的维权行动,再到兴蓝风电近年的维权行为,涉及三代整机商的诉讼纠纷已持续15年[1]。
截至2025年底,中国风电累计装机已超22.7万台[1]。在市场规模方面,2025年陆上风电后市场规模超过700亿元,海上风电后市场突破80亿元,2026年技改市场容量预计超过80亿元[1]。兴蓝风电累计安装运行风电机组超7000台,总容量超18GW;华锐风电的累计装机超过1600万千瓦[1]。2025年全年,央企在风电运维服务招采占比达到96%[1]。

The intellectual property dispute reflects a persistent problem spanning over a decade and a half in China's wind power sector. The conflict traces back to 2011 when American Superconductor sued Huarui Wind Power, which ultimately resulted in compensation of 57.59 million U.S. dollars. Against this backdrop of industry-wide disputes, the retrofit market has become increasingly significant. China's cumulative installed wind power capacity exceeded 2.27 million turbines by the end of 2025, with the onshore wind power retrofit market exceeding 700 billion yuan and the offshore wind power retrofit market surpassing 8 billion yuan. [1] The retrofit market capacity is projected to exceed 8 billion yuan in 2026. [1] Xinlan Wind Power itself operates over 7,000 installed wind turbines with a total capacity exceeding 18 gigawatts, [1] while Huarui Wind Power has accumulated installations exceeding 16 million kilowatts.
