A divided federal appeals court in Washington, D.C., ruled Tuesday that the Trump administration improperly terminated a multibillion-dollar initiative designed to advance clean energy projects.[1] The decision vindicated nonprofit organizations, including Climate United Fund, that had been selected to operate the Biden-era green bank program.[1] EPA Administrator Lee Zeldin had frozen and terminated funding to these groups, alleging "mismanagement and potential fraud," but the court determined such actions violated both law and constitutional principles.[1]
The terminated program constitutes a congressionally authorized Greenhouse Gas Reduction Fund.[1] Zeldin had frozen billions of dollars allocated for the initiative in Citibank accounts.[1] The court's divided decision will remain stayed for several days, allowing the EPA an opportunity to file an appeal to the Supreme Court.[1]
