中国自9月15日起实施新的出入境管理规定[1]。根据新规，涉及出口管制或技术安全的人员将面临出境限制[1]。具体而言，中国公民若违反出口管制、技术进出口管理等规定，可能危害国家产业安全、技术安全，国务院商务等有关主管部门可以决定不准其出境[1]。
新规共19条，由司法部、公安部、国家移民局联合发布[1]，已于7月31日公布[1]。规定将出入境申请办理方式从传统文件填表改为需配合询问确认真实意图，相关权力下放至县级以上公安机关[1]。此外，外国人因妨害国（邊）境管理受到刑事处罚，或因非法出境入境受到行政处罚，移民管理机构可决定自处罚执行完毕之日起1年至5年以内不准其入境[1]。新规旨在规范出入境管理并维护国家主权、安全和发展利益[1]。
China will enforce new entry and exit management regulations starting September 15, 2024, which grant authorities expanded power to prevent certain citizens from leaving the country.[1] The regulations, comprising 19 provisions and released on July 31, 2024, were developed by the State Council with input from the Ministry of Justice, Ministry of Public Security, and National Immigration Administration.[1]
Under the new rules, Chinese citizens engaged in activities related to export controls or technology imports and exports who may jeopardize national industrial or technological security can be barred from departing by relevant departments under the State Council, such as the Ministry of Commerce.[1] The regulations also establish that foreign nationals convicted of crimes obstructing border management, or administratively penalized for illegal entry or exit, can be prohibited from entering China for a period of one to five years following completion of their punishment.[1] The application process has been modified to require applicants to cooperate with official inquiries to verify their stated intentions, moving away from the traditional document-based filing system.[1] Implementation authority has been delegated to public security organs at the county level and above, with the stated objective of standardizing entry and exit management while safeguarding national sovereignty, security, and development interests.[1]
