为防止保障房偏离用途,新合同划定持有期间五不准红线:不得出租、不得擅自转让、不得抵押、不得改变居住功能、不得设立居住权[1]。配售型保障房被永久封闭,禁止以任何方式变更为商品住房[1]。购房者自签订买卖合同之日起满3年方可申请封闭流转[1]。超过1年未成功转让的,主管部门可按原价×(1-1%×使用年限)的公式组织回购[1]。此外,骗购方式取得住房的购房者在10年内禁止再次申请[1]。

The new agreements establish five strict prohibitions on buyer conduct during the holding period: rental of the property is forbidden, as are unauthorized transfers, mortgaging, alterations to residential function, and establishment of residential rights [1]. Additionally, allocated affordable housing units are permanently prohibited from conversion to commercial residential properties under any circumstances [1]. Buyers may apply for closed-market transfers only after three years from contract signing [1]. Properties failing to transfer within one year may be repurchased by authorities using a formula of original price multiplied by (1 minus 1 percent per year of use) [1]. Applicants found to have fraudulently obtained such housing face a ten-year ban on reapplication [1].
This policy development follows Shenzhen's December 2023 launch of the first batch of 13 allocated affordable housing projects, collectively comprising over 10,000 units [1]. Three projects have already received official confirmation: Luohu Yuefeng Zunfu, Nanshan Qihe Lijiao Manor, and Futian Fucui Garden [1].
