An Australian appeals court has reversed a lower court ruling and determined that video evidence is admissible in the case against two former Bankstown Hospital nurses.[1] Sarah Abu Lebdeh and Ahmad Rashad Nadir face charges of using a communications service to harass and threaten an Israeli content creator through the Chatruletka video chat application in February 2025.[1] Abu Lebdeh additionally faces allegations of threatening to use violence against a group.[1] Both defendants have pleaded not guilty.[1]
The New South Wales District Court had ruled last month that the video should be excluded, but the appeals court overturned that decision on July 31.[1] Prosecutor Paul Holdenson KC argued that "the jury can only properly understand the case if they are able to see and hear the conversation, understand the tone, body language and facial expressions."[1] Following the incident, both nurses were dismissed from their positions.[1] The trial is scheduled to commence in late August 2026.[1]
