New York City Mayor Zohran Mamdani acknowledged on Tuesday that the city has no independent legal authority to enforce an International Criminal Court arrest warrant against Israeli Prime Minister Benjamin Netanyahu, despite having pledged during his campaign to arrest Netanyahu if he visited New York for the United Nations General Assembly. [2][3]
In a video statement, Mamdani declared: "It is clear that we do not have the independent legal authority to enforce this warrant." [2] He subsequently called on the federal government to take action, stating: "The federal government however does and I call on them to join the ICC and execute this warrant." [2] At a Wednesday press conference, Mamdani reiterated his position, urging: "I call on the federal government to join the International Criminal Court, enforce this warrant as well as any other warrants the ICC holds." [4]
The ICC issued the arrest warrant against Netanyahu in 2024 on charges related to alleged war crimes in Gaza. [1][4] The charges include using "starvation as a method of warfare" to restrict humanitarian aid and deliberately targeting civilians. [2][4] The court also issued a warrant for former Israeli Defense Minister Yoav Gallant on similar grounds. [2][4]
Netanyahu is expected to visit New York in September to attend the UN General Assembly. [1][3]
President Donald Trump responded to Mamdani's stance by asserting on social media that Netanyahu "will not be arrested, in any way, shape, or form, while in the United States of America." [2][3] Secretary of State Marco Rubio has also threatened this month to "destroy" the International Criminal Court. [4]
The United States and Israel are not signatories to the ICC and do not recognize the court's authority. [1][4] Israel's UN Ambassador Danny Danon criticized Mamdani's remarks, saying: "You were elected to serve New Yorkers, not Hamas' propaganda." [2]
