Preston Tolth, the sole person charged in connection with the 2021 disappearance of Navajo elder Ella Mae Begay, was arrested on July 3 by Phoenix police on an unrelated burglary charge, raising questions about whether he will be sent back to federal prison for violating the terms of his supervised release.[1] Tolth had been released from federal custody in June after serving his sentence for his role in Begay's disappearance, having been freed two years ahead of his original scheduled release date.[1]
During the burglary arrest, police found Tolth wearing clothing consistent with the suspect's description and carrying a folding knife.[1] Under the conditions of his parole agreement, Tolth is prohibited from committing any additional crimes or possessing dangerous weapons during his supervised release period.[1] The U.S. Marshals Service held a valid arrest warrant for Tolth at the time of his arrest by Phoenix police.[1] Additionally, Tolth violated regulations at his transitional housing facility, Phoenix Oasis, by returning intoxicated on July 4 and refusing to be transported to a medical center.[1]
Tolth has admitted to stealing Begay's truck, beating her, and abandoning her; he was last seen with her in May 2021 when she disappeared.[1] Begay's family expressed disappointment over his release from prison.[1]
