The U.S. Department of Education announced Tuesday that it is investigating the Denver Public Schools and Bethel School District in Washington state over separate incidents involving LGBTQ+ students and materials.[1] The department contends that these events may violate federal law granting parents the authority to opt out of school assessments involving matters of sexual conduct or attitudes.[1]
In Denver, a teacher required same-sex students to kiss each other during class.[1] The educator was suspended after students reported the incident in March 2025 and was subsequently terminated by the school board in May.[1] Meanwhile, at Graham-Kapowsin High School in the Bethel district, testosterone vials were displayed at an exhibition during June without authorization from school administrators.[1] The vials have been removed and turned over to the Pierce County Sheriff's Office.[1]
The Department of Education claims both incidents breach Title IX protections and federal privacy regulations.[1] Frank Miller, the department's director, stated: "Parents must be the decision-makers in the most intimate aspects of their children's lives."[1] This action is part of a broader initiative by the Trump administration, which has already launched investigations into dozens of schools regarding their practices accommodating transgender and LGBTQ+ students.[1]
