A UK High Court judge has suggested that the Home Office relied on information that appears to have been hallucinated by artificial intelligence when refusing an asylum application from a Moroccan woman fleeing domestic abuse.[1]
In a ruling dated July 14, 2024, the judge stated that the Home Office's refusal letter "bears hallmarks consistent with the use of artificial intelligence" and noted that the decision cited a Country Policy and Information Note (CPIN) on Morocco that "appears that no such CPIN has ever existed."[1] The judge warned that AI "hallucination" may have led officials to reference a non-existent document, describing reliance on such fabricated evidence as "analogous to relying on bogus evidence."[1] Morocco has not issued this type of public policy file since 2017, according to the judgment.[1]
The woman's asylum claim was based on threats to her life from her husband.[1] Internal Home Office documents cited in the case indicated that Morocco recorded 40,000 child marriages in 2018, representing one-fifth of all marriages that year.[1] The judge determined that the Home Office's decision-making process constituted a procedural violation.
