中国第二部法典《生态环境法典》将于2026年8月15日起施行[1]。这是继《民法典》之后中国颁布的第二部法典,也是世界首部以"生态环境"命名的法典[1]。
为做好法典实施准备,生态环境部已全面梳理30余部行政法规、80余部部门规章、400余件规范性文件[1],对其中与法典要求不一致的内容进行修改或废止,确保各项制度与法典精准适配[1]。
《生态环境法典》共设5编1242条,内容依次为总则、污染防治、生态保护、绿色低碳发展、法律责任和附则[1]。该法典于2023年11月正式启动编撰工作[1],2026年3月经全国人大审议通过[1]。
China's second legal code, the Ecological Environment Code, will take effect on August 15, 2026.[1] The Ministry of Ecology and Environment has undertaken a comprehensive review of more than 30 administrative regulations, over 80 departmental rules, and more than 400 normative documents to identify and address inconsistencies with the new code's requirements.[1]
The Ecological Environment Code represents a significant legislative achievement for the nation.[1] Comprising five sections and 1,242 articles, the code covers general provisions, pollution prevention, ecological protection, green and low-carbon development, legal liability, and supplementary provisions.[1] The drafting of this code began formally in November 2023 and was approved by the National People's Congress in March 2026, making it China's second comprehensive legal code following the Civil Code and the world's first code named specifically for ecological and environmental protection.[1]
The Ministry of Ecology and Environment is systematically modifying or repealing existing regulations and rules that conflict with the new code's provisions to ensure seamless alignment of all systems and requirements.[1]
