Luckin Coffee has prevailed in its trademark infringement lawsuit against a Thai company in a decision hailed as the first of its kind in Thai judicial history. On July 8, 2024, Thailand's Specialized Cases Appeal Court ruled that defendant Royal 50R Group committed trademark bad-faith registration and infringement, ordering the revocation of the registered Luckin trademark and prohibiting further use of the associated marks.[1]
The court mandated that the defendant pay a base damages award of 10 million Thai baht, along with ongoing compensation calculated at 100,000 Thai baht per day beginning from March 4, 2024, bringing the total compensation to over 95 million Thai baht.[1] The ruling permanently bars the defendant from using "LUCKIN COFFEE," "Luckin Coffee," or the deer head logo in coffee-related business operations.[1] This judgment represents the first formal judicial precedent in Thailand acknowledging the concept of "trademark bad-faith registration."[1] The dispute spans five years, originating from Luckin's filing of the lawsuit in 2021.[1]
