A New York State Supreme Court judge has dismissed all claims in a defamation lawsuit brought by Morgan Carey against his sister, singer Mariah Carey, over statements made in her 2020 memoir.1 Judge Leslie Stroth ruled on Monday that Morgan failed to establish the legal standard of "actual malice"—proving that Carey knew her written descriptions were false or acted with reckless disregard for the truth.1 In her book, Carey had described her brother as a "sometimes drug dealing, been-in-the-system, drunk-ass brother."1
Morgan filed the lawsuit in New York State Supreme Court in 2021, initially seeking damages for what he claimed were false and damaging portrayals.1 A prior ruling by Judge Barbara Jaffe in 2022 had narrowed the case by dismissing 14 of the original claims but preserving two defamation counts related to allegations of drug dealing and violence.1 In his amended complaint, Morgan sought more than $1.5 million in damages, asserting that the memoir had caused a collaborative film project to be cancelled.1 However, Stroth's decision this week eliminated the remaining charges entirely.
Morgan's legal team indicated plans to appeal the dismissal, according to statements made to Variety.1 The case is one of multiple defamation suits stemming from Carey's memoir; her sister Alison had filed a separate $1.2 million defamation claim in 2021 but did not pursue it further before her death in 2024 at age 63.1
