According to prosecutors, Alfozan conducted suspicious online searches through a chatbot account associated with his spouse between September 24 and 30, querying topics such as "building continuous audio recorders," "custom Wi-Fi connections," "improved audio and real-time monitoring," and "encrypted SD cards."6 On October 5, Alfozan returned to the conference room to check on the device and subsequently left an unattended backpack in another room containing a wallet, identification, and a second recording device.6 U.S. Attorney Craig Missakian characterized the incident as "a national security issue" for the government.6
OpenAI has stated it found no evidence that Alfozan unlawfully accessed model weights, source code, or customer data.36 The company terminated Alfozan's employment and reported the matter to the FBI.1 If convicted, Alfozan faces a maximum of five years imprisonment and a fine of $250,000, followed by three years of supervised release.6
