The Entertainment Software Association has petitioned the Office of the U.S. Trade Representative to designate Chinese hardware manufacturer Anbernic as a notorious market, citing what it describes as "superfake" piracy operations.1 The ESA contends that Anbernic's handheld gaming devices typically arrive pre-loaded with hundreds or thousands of unauthorized game copies, effectively normalizing hardware-based copyright infringement through mainstream retail channels.1
The ESA, which represents major gaming publishers including Nintendo, Microsoft, PlayStation, Amazon, Epic Games, EA, and Ubisoft, argues that these pre-installed ROM devices constitute a distinct category of counterfeiting activity.1 By positioning emulation handhelds with unlicensed software as legitimate consumer products sold through conventional distribution networks, the association claims Anbernic has industrialized a form of piracy that blurs the line between counterfeit goods and standard commerce.1
