Luke Ings and Leiam Bennett have been released following High Court review of their indefinite imprisonment sentences, each having served approximately 20 years despite minimum terms of just 21 and 24 months respectively 1. The pair, along with a third man, James Ward, had their original sentences quashed and replaced with fixed terms following a Criminal Cases Review Commission examination 1. Bennett was re-sentenced to four years and 264 days, Ings to 42 months with a 30-month extended licence, and Ward to two years 1.
All three men received their original Indeterminate Public Protection (IPP) sentences between 2006 and 2007 in courts across Wolverhampton, Reading, and Leicester 1. Ings and Bennett were 17 years old at sentencing, while Ward was 21 1. The court determined that the original determinations regarding the defendants' dangerousness lacked proper foundation 1. IPP sentences were abolished in 2012, but this change was not applied retrospectively to existing cases 1.
More than 2,000 prisoners remain indefinitely detained under IPP sentences, with 99 percent having exceeded their minimum terms and 80 percent having served at least 10 years 1. Justice Secretary Alex Norris has stated the government intends to introduce legislation to permanently end IPP sentencing before the current parliamentary session concludes 1.
