Female students at Cornell University have alleged they were intoxicated and drugged before being sexually assaulted by multiple male students in 2024, prompting scrutiny of New York State's legal framework governing consent and incapacity.1
The current New York law sets a high threshold for establishing incapacity, requiring victims to prove they were "unconscious or for any reason physically unable to express unwillingness."1 This standard means that voluntary intoxication alone does not automatically render someone incapable of consent in the eyes of the law, even in sexual assault cases.1 At least 19 states, including New York, have adopted similarly elevated standards for determining alcohol-related incapacity.1
The case has drawn criticism from legal experts and state leadership. Governor Kathy Hochul stated that "voluntary intoxication is not a license for sexual assault or gang rape."1 Prosecutor Mitchell Eppner analogized the threshold to driving ability, arguing that "if someone is too drunk to drive, they're too drunk to fill in the blank verb."1 In contrast, the New York Criminal Defense Lawyers Association maintains that existing law is sufficient and warns that proposed alternative language—which would shift the standard to "temporarily incapable of appraising or controlling their conduct"—is too vague.1
The New York State Senate has passed reform legislation multiple times to lower the incapacity threshold, but the measure has not yet been voted on by the State Assembly.1
