Supreme Court Justice Ketanji Brown Jackson has criticized the court's use of its emergency docket, warning that the practice poses a serious threat to public confidence in the judicial system.1 Speaking at David A. Clarke Law School at the University of the District of Columbia, Jackson stated that "there is a serious concern that the supreme court's modern stay practices are having a disruptive and potentially corrosive effect."1 She cautioned that without careful oversight, "the emergency docket can and will become an end-run around the standard review process."1
Jackson's remarks come as the Trump administration, which returned to office in January 2025, has submitted more than 30 emergency requests to the court, with the conservative-majority bench approving most of them.1 Through these expedited procedures, conservative justices have allowed the administration to suspend immigration asylum protections, eliminate transgender rights protections, and roll back environmental safeguards.1 While Justice Elena Kagan told Congress in July that she believed the court was improving how it handles emergency requests, Jackson indicated that recent improvements remain insufficient.1 She acknowledged that the court "began to explain more" but stated this amounts to "still not the full kind of explanation" required by normal case review standards.1
