The ICO's investigation, covering the period from 2018 to 2020, found that TikTok did not adequately restrict access by underage users, failed to remove identified child accounts, and did not provide information about data collection practices or seek parental consent.1 During 2020 alone, as many as 1.75 million UK children under 13 were active on the platform.1 TikTok's terms of service set a minimum age requirement of 13 years, while the platform has more than 30 million users in the UK.1
Emily Keaney, the ICO's deputy commissioner, stated that the agency's action "shows how important it is for companies to have the right protections in place, including to prevent access by children who are not old enough to be using their services."1 The UK government plans to introduce a ban on social media use by those under 16 beginning next year.1 Australia implemented a similar age restriction last December, though its cyber safety commissioner reported that a "significant proportion" of minors have retained accounts or circumvented age verification systems.1
