深圳市宝安区西乡街道近日通报了三起欠薪典型案件，涉及文化公司、关联企业集团和酒吧等三家企业，共涉及287名劳动者，欠薪总额197万元1。通过行政执法与刑事司法的衔接配合，相关部门已成功推动欠薪清偿和对违法企业负责人的刑事处罚。
某文化发展有限公司拖欠18名员工工资合计40万余元1。经西乡街道与宝安区人力资源局协同行动，该企业负责人罗某被刑事拘留，随后筹措资金支付了全部欠薪1。三家关联企业共拖欠72名员工工资67万元1，通过行刑衔接、破产清算等程序最终得到完全清偿1。此外，某酒吧拖欠110人2024年8月至9月工资、劳务费等约90万元1，5名负责人因此被刑事拘留1。
根据《刑法》第二百七十六条之一的规定，拒不支付劳动报酬"数额较大"且经政府部门责令支付仍不支付的，处三年以下有期徒刑或拘役1。在深圳等一类地区，"数额较大"的标准为：拒不支付一名劳动者三个月以上报酬且累计在二万元以上，或拒不支付十名以上劳动者报酬且累计在十万元以上1。西乡街道累计立案67宗欠薪案件（占全区17.6%），作出行政处罚13宗（占全区13.1%），为劳动者的合法权益提供了有力保护1。

In the first case, a cultural development company owed 18 employees over 400,000 yuan in wages.1 After the company's principal was criminally detained, funds were mobilized to settle all arrears in full.1 The second involved three affiliated enterprises that collectively withheld 670,000 yuan from 72 workers.1 Through coordinated criminal and administrative procedures and bankruptcy liquidation, all workers received complete compensation.1 A third case centered on a bar that failed to pay 110 workers approximately 900,000 yuan in wages and service fees for August and September 2024.1 Five individuals responsible for the establishment were criminally detained.1
Under Article 276-1 of China's Criminal Law, deliberately refusing to pay worker compensation—when deemed "substantial in amount" and persisting after government authorities order payment—carries penalties of up to three years imprisonment or criminal detention.1 In Shenzhen and other first-tier cities, "substantial in amount" is defined as withholding three months' wages for one worker totaling 20,000 yuan or more, or withholding wages for ten or more workers totaling 100,000 yuan or more.1 Since 2026, Xixiang Subdistrict has filed 67 wage theft cases, accounting for 17.6 percent of the district total, and issued 13 administrative penalties representing 13.1 percent of district enforcement.1
