Britain's Court of Appeal has determined that Deputy High Court Judge Richard Clayton acted improperly by conducting a case via video link from his hospital bed while recovering from surgery.1 Clayton dismissed an appeal from optometrist Suleman Patel the day after undergoing surgery for a ruptured Achilles tendon, prompting Patel to subsequently lodge a complaint with the appellate court.1
While the Court of Appeal upheld Clayton's substantive ruling in the case, it found his decision to preside over the hearing under such physical circumstances was inappropriate.1 Judge Phillips, who authored the court's decision, stated that "judges should only sit when they have the necessary facilities to do so, unless there are special circumstances of urgency or the case can only be dealt with by a particular judge."1 Clayton himself acknowledged the difficulty of his situation, noting that "lying in a prone position on a hospital bed made it hard for me to operate some PDF files."1 Medical guidance recommended that Clayton remain unable to stand for eight days following his operation.1 The ruling was first published on Tuesday and reported by the legal news website Legal Futures.1
