China's Supreme People's Court, Supreme People's Procuratorate, and Ministry of Public Security have jointly issued new guidance on prosecuting fentanyl-related offenses, establishing clear sentencing standards for such crimes.12 The directive, comprising 18 provisions, takes effect on September 23, 2026.1
The guidance classifies fentanyl-type substances into two categories: pharmaceutical and non-pharmaceutical.12 Pharmaceutical variants are subject to sentencing thresholds based on fentanyl quantity standards, while non-pharmaceutical variants are assessed using heroin quantity benchmarks.1 A key provision states that smuggling, trafficking, transporting, or manufacturing fentanyl-related substances will trigger drug crime charges regardless of quantity involved.1 Public security agencies are directed to intensify monitoring and interdiction efforts across logistics, mail services, international parcels, and internet channels.1 Courts are instructed to apply enhanced penalties to source-level offenses, including large-scale trafficking, manufacturing, and smuggling operations.1
The issuance of these standards reflects ongoing international cooperation in narcotics enforcement.2 China and the United States established a drug control cooperation working group in 2024.2 In September, the two countries jointly cracked a cross-border drug case resulting in 23 arrests, including two Chinese nationals.2
