New South Wales Premier Chris Minns has announced significant reforms to sexual assault trial procedures, including restrictions on questions based on rape myths, to reduce the trauma experienced by victims during court proceedings.1 These widely held false beliefs center around a "real rape" script that requires victims to conform to narrow standards—such as being young and morally unblemished—in order for their experiences to be considered legitimate sexual violence.1
Research spanning the past three decades has established a correlation between belief in rape myths and the perpetration of sexual violence.1 These misconceptions function to minimize, erase, or justify sexual assault, creating a distorted framework through which society evaluates victims and offenders alike. The 2025 Australian Law Reform Commission report found that the justice system has failed to hold perpetrators of rape and sexual assault accountable.1 As early as 1977, the Royal Commission on Human Relationships identified rape myths as a critical factor in legal system failures.1
The scope of underreporting reflects the pervasive impact of these myths on victim behavior. In 2021-22, only 8 percent of women who had been raped or sexually assaulted reported the crimes to police, a dramatic decline from 19 percent in 2012.1 The reforms now underway represent a recognition that judicial practices must actively counter the harmful narratives that discourage survivors from seeking justice and shield offenders from accountability.
