The U.S. Supreme Court has declined to intervene in a custody battle between a California couple and an Alaska surrogate mother over a newborn with a severe heart defect.2 Justice Kagan rejected an emergency appeal filed by the surrogate mother, McKenna West, who sought custody and medical decision-making authority for the infant.4
