为防范风险,新条例强化了监管要求。对于违法提取住房公积金的行为,规定3年内不得提取住房公积金或使用住房公积金贷款1;对于违法获得住房公积金贷款的行为,5年内不得提取住房公积金或使用住房公积金贷款1。同时,新规简化办事流程,实现了全国缴存记录互信互认,住房公积金管理中心受理提取申请后需在3日内作出准予或不准提取的决定1。
The newly amended Housing Provident Fund Management Regulations came into effect today, significantly broadening access to accumulated funds for workers across China.1 The revised regulations expand withdrawal scenarios from six to nine categories, now permitting employees to draw funds for home renovations and property management fees on their self-occupied residences.1 Additionally, the regulations eliminate previous restrictions on rental payment withdrawals, removing the requirement that rent exceed a specified percentage of household income.1
The regulations also introduce new flexibility for self-employed and gig workers, allowing them to voluntarily contribute to housing provident funds.1 To safeguard against misuse, the updated rules impose stricter penalties: individuals who fraudulently withdraw funds are prohibited from making further withdrawals or taking out housing provident fund loans for three years, while those who obtain loans through fraud face a five-year ban on both withdrawals and loans.1 Processing timelines have been streamlined, with management centers required to issue approval or denial decisions within three days of application.1 The new framework also implements mutual recognition of contribution records nationwide, simplifying application procedures across different jurisdictions.1 Several cities including Yichang, Jinan, and Liuzhou have already begun implementing provisions allowing flexible employment participants to contribute to the fund.1
