China's Ministry of Commerce expressed serious concerns on September 17 regarding the European Commission's proposed Public Procurement Law, which includes an "European First" clause designed to exclude third-country enterprises.12 The draft legislation incorporates non-market factors such as security into evaluation criteria and restricts or eliminates participation by non-compliant enterprises from outside the EU.12
Spokesperson He Yaodong stated that China is highly concerned about these provisions.2 The ministry urged the European side to comply with World Trade Organization rules, maintain market openness, and amend the discriminatory clauses in the legislation to create a fair business environment for Chinese companies.12 Officials indicated they will closely monitor the EU's legislative process and promptly assess the related impacts.2
The ministry's response comes as part of a broader pattern of EU legislation this year. According to the Commerce Ministry, the European Union has consecutively introduced multiple measures including amendments to the Cybersecurity Law, the Industrial Accelerator Act, and the Public Procurement Act, which the Chinese side views as protectionist actions carried out under the guise of network security and industrial development concerns.1
