China's revised entry-exit regulations will take effect on September 15, expanding the authority of immigration management agencies in ways that have drawn warnings from Taiwan officials and legal experts.1 The new rules grant immigration authorities the power to demand inspection of electronic devices such as mobile phones and computers from travelers.1 Additionally, the regulations prohibit individuals involved in high-technology and semiconductor sectors from leaving the country.1
Officials and experts have raised alarm over the scope and potential consequences of these measures. Shen Youzhong, deputy head of Taiwan's Mainland Affairs Council, cautioned that the expanded powers of immigration agencies could lead to leaks of commercial secrets and expose political speech, while also creating risks to personal safety.1 According to the regulations, individuals found to have violated export controls or regulations on technology transfer may be prevented from departing China.1 A particularly concerning provision allows immigration authorities to restrict departure without informing the affected person of the restrictions, reasons, legal grounds, or available remedies when such action might affect national security or criminal investigations.1
Legal experts have confirmed that Taiwan residents fall within the scope of these restrictions. Luo Chenggong, a professor at Kaohsiung Science and Technology University, noted that under China's constitution and various laws, Taiwan residents are defined as Chinese citizens.1 Xu Kaijie, a judge at the Taipei District Court, affirmed that Taiwan residents are "absolutely within the scope of these restrictions."1 The Taiwan Mainland Affairs Council has indicated it has no current plans to raise the China travel warning level.1
