A San Jose police officer has been terminated after unlawfully accessing the department's Flock automatic license plate reader system to obtain location information about a domestic abuse victim and share it with a suspect in the case, who was the officer's cousin.1 The officer accessed Flock camera data on a personal mobile device without authorization and transmitted the victim's vehicle location to the domestic violence suspect.1
Police Chief Paul Joseph expressed his disapproval of the breach, stating: "I am angry that an officer would betray the public's trust in such a manner, without recognizing how serious of a violation this is."1 Although the department referred the case to the Santa Clara County District Attorney's Office, the officer was not charged with any criminal offense.1 However, the department has forwarded the matter to the Commission on Peace Officer Standards and Training, which possesses the authority to revoke the officer's law enforcement certification in California.1
California's legislature has failed for a fifth consecutive year to implement new protections governing license plate reader technology, and Governor Newsom vetoed legislation last year that would have imposed additional regulations on such systems.1
