The court found insufficient evidence to support his claim that these amounts represented loans rather than gifts.1 In his judgment, the judge observed that "the evidence clearly shows that the applicant was besotted with the respondent and gave her expensive gifts during the course of their relationship," noting that "unfortunately when their relationship ended in an unpleasant manner, he became resentful and determined to exact a price from her."1 The judge further emphasized that Agarwal only attempted to recover the funds after the relationship deteriorated.1
