A University of Hong Kong law professor has conducted extensive research into China's divorce litigation practices, uncovering patterns that reveal how judicial decisions are shaped by broader social and economic forces.1 Through fieldwork spanning multiple provinces including Guangdong and Shaanxi, where he observed numerous divorce cases and court mediations, the scholar discovered that first-instance courts rarely grant divorce on the initial petition.1 The research also involved interviews with frontline judges from Jiangsu, Guangxi, and Zhejiang.1
The findings illuminate how power imbalances, economic disparities, and gender inequalities present in family life carry over into the courtroom.1 Beyond personal circumstances, judges face institutional pressures that influence their rulings—including concerns about letters of petition and the risk of violent incidents—making "social stability" a practical consideration in divorce adjudication.1 The scholar's analysis traces the evolution of divorce policy back to 1989, when the Supreme People's Court issued guidelines that relaxed restrictions on divorce.1 However, a "difficulty in obtaining divorce" emerged after 2001.1
These findings have been compiled into a book titled "Chinese-Style Divorce," scheduled for publication in August 2026.1
