Bride price is defined as a substantial sum of money given with the mutual agreement of both parties in accordance with local marriage customs, contingent upon the couple actually getting married.1 In contrast, gifts exchanged on holidays, birthdays, or other commemorative occasions with modest monetary value, as well as everyday consumer spending, do not qualify as bride price.1 Courts distinguish between the two categories by examining three factors: whether the couple had entered serious marriage negotiations, whether the amount was notably large, and whether the transfer followed local customs.1
According to the Supreme People's Court's judicial interpretation, when a couple has already registered their marriage and lived together, divorce proceedings generally do not support claims for bride price recovery.1 However, in special circumstances—such as when the couple lived together for only a brief period and the bride price sum was excessively high—courts may order partial return of the funds.1
To protect their legal interests, individuals are advised to conduct large transfers through banks or digital payment platforms like Alipay or WeChat, with transaction notes clearly identifying payments as "bride price" or "engagement gift," and to retain purchase receipts as documentation.1 When receiving bride price, parties are encouraged to confirm the nature of payments in writing and preserve evidence such as medical records and chat histories in case of subsequent disputes.1
