California is poised to become the first state in the nation to create comprehensive smoke pollution damage standards and testing protocols following devastating wildfires in January 2025.1 Two pending bills awaiting the governor's signature aim to establish testing and remediation benchmarks, require insurance companies to comply with these standards, and hold insurers accountable for prolonged delays and claim denials.1
The January fires destroyed more than 16,000 buildings across Los Angeles County, with more than 13,000 of over 40,000 fire-related insurance claims involving smoke contamination.1 Many of these homes were not burned but remain uninhabitable due to toxic substances such as lead and asbestos seeping into structures.1 Assembly Bill 1642, authored by Pasadena Democratic Assemblymember John Harabedian, will establish the first-ever smoke pollution detection and remediation standards in the nation, while Assembly Bill 1795, authored by Gardena Democratic Assemblymember Mike Gibson, requires insurance companies to adhere to these new standards.1 The governor must sign both bills by month's end, though one cannot become law independently.1
The Department of Toxic Substances Control is required to develop lead and asbestos testing, repair, and removal standards by the end of 2028, with standards for other contaminants to be established by the end of 2029.1 The case of the Karim Ali family illustrates the stakes: unable to return home since January 2025, they have been living in a donated RV on their own property after State Farm Insurance denied their environmental testing request.1 Los Angeles County sued State Farm last week, alleging unfair business practices in handling fire claims, including refusing and blocking environmental testing requests and denying reimbursement for self-funded testing expenses.1 State Farm Insurance spokesperson Sevag Sarkissian stated the company "strongly disputes" the county's characterization of its claims response.1
Three companion Senate bills also advance insurance reform measures: Senate Bill 876 requires insurers to designate a primary contact within 30 days of claim submission and submit a written report when assigning a third adjuster in the sixth month;1 Senate Bill 877 mandates insurers provide detailed calculations of loss amounts, covered damages, and repair costs within 15 days of request;1 and Senate Bill 878 requires insurers to pay cash value within 30 days of a total loss determination, with interest owed for late payment.1
