The European Court of Justice has sided with IKEA in a trademark infringement case against Belgium's far-right Vlaams Belang party, ruling that the political group illegally used the furniture company's trademark in a 2022 anti-immigration campaign 12. The party had launched what it called the "IKEA Plan – Immigration Really Can Be Different" using imagery similar to IKEA's assembly instructions, prompting IKEA to file a legal complaint in 2023 12.
The court determined that the use of IKEA's trademark could cause significant harm to the company's brand reputation and interests 2. While the party and the associated Vrijheidsfonds organization argued their use was protected by freedom of expression, the European Court of Justice rejected this defense 2. The court found that invocation of free speech requires the trademark to be used "in good faith or in the public interest," conditions which the court concluded were not met in this case 2. According to the court's ruling, trademark owners may prevent political parties from using their marks unless the parties can demonstrate that freedom of expression takes precedence over the trademark holder's rights 1.
The Belgian courts will now use the European Court of Justice's guidance to render a final decision on the matter 2.
